Rezoning process

The rezoning application process depends on whether your property is within or outside the Town Planning Scheme boundary.

  1. Properties with the Town Planning Scheme boundary (Scheme Amendment)
    1. Lodge a rezoning application with the relevant forms, documents and fees.
    2. If provisionally approved, the Council to advertise the provisional approval in the Fiji Government Gazette and the newspaper on Friday and undergo an objection period of 15
    3. Once the objection period has ended you can apply through the Council for Final Approval which if forwarded to the Department of Town & Country Planning for the Director’s approval.
    4. If there are objections to your provisional approval, the Department of Town & Country Planning must first address all objections before endorsing a Final Approval
    5. If approved, the Council to advertise the Final Approval in the Fiji Government Gazette and the newspaper on Friday.
    6. Undertake the required works in compliance with the conditions of the approval.
  1. Properties outside the Town Planning Scheme boundary
    1. Lodge a rezoning application with the relevant forms, documents and fees.
    2. If approved, undertake the required works in compliance with the conditions of the approval provided by Department of Town & Country Planning

Application Requirements

Please be informed that the following will be required by the Council as part of Application for Rezoning:

  1. Application forms – [3 x Nadi Town Planning Scheme Form]
  2. Applications to include 3 sets of plans (A3 size), which must include:
  • Locality Plan
  • Site Plan (boundary pegs & dimension as per survey plan)
  • If building is existing on site than applicant must provide the floor layouts and building clearances from boundary line.
  • Show & mark service lane on site plan if rezoned to commercial.
  1. Rezoning to Commercial – Applicant to submit a Statutory Declaration to vest and dedicate service lane to Fiji Roads Authority (FRA).
  2. Title Copy/Legal Ownership Documents to be submitted.
  3. Landlord’s Consent [iTLTB, Lands Department, Housing Authority]
  4. Development brief or supporting letter – outlining the purpose of rezoning, intentions and proposed activity to be carried out.
  5. Lodgement Fees [Inclusive of DTCP fees].

Lodging an Application

We recommend to have a pre-consultation meeting with the department staff or the Department of Town and Country Planning to help you prepare your planning application. This is not mandatory but will save you time and make the process easier.

 

Application Timeline

The processing time line for rezoning applications is 45 working days. During the assessment period, the Department of Town & Country planning liaises with the Council for further information and amendments if necessary.

 

Expired Approvals

Rezoning approvals for properties outside the Town Planning Scheme boundary have a validity of two (2) years. If your scheme approval 

Subdivision & Compliance

Subdivision is essentially a process of dividing a parcel of land into one or more further parcels.

Sub-Division Process

  1. Lodge a subdivision scheme application (proposal is more than 5 acres) with the relevant forms, documents and fees.
  2. Assess by the Council planning team for recommendation.
  3. Comments and remarks to be addressed by the applicant.
  4. Application and report which are then forwarded to the Department of Town and Country Planning for consent.

(However, if the proposal is less than five (5) acres the application will need to be lodged at the Department of Town & Country Planning Suva).

Application Requirements

When lodging an application, you must provide the following documents:

  1. 7 Copies of Subdivision Form
  2. 7 Copies Town Planning Application for Development Forms
  3. Proof of Ownership
    • Freehold
      • Clear copy of the Certificate of Title
    • Native Land
      • Land Development Vetting Committee Comments
      • Survey Instruction
      • Agreement for Lease
    • State Land
      • Letter of Consent from the Ministry of Lands and Mineral Resources
      • Copy of the Approval Notice/Lease
  1. 7 Copies of Scheme Plan (in accordance with Subdivision of Land Regulations).
  2. Covering Letter stating the purpose of the subdivision.
  3. Other relevant documents e.g., Sale and Purchase Agreement, Will and Probate, Consent from Sugar Industry Tribunal (for cane land).

Subdivision Compliance/Inspections

To ensure the subdivision completion is in compliance with the conditions of the Approval, inspections are required and Applicant/surveyor to provide the following documents:

  1. Clearence letter/cover letter from the surveyor.
  2. Subdivision approval with conditions.
  3. Scheme plan approval.
  4. Fees of $57.50

Application Fees

You must pay a development application fee when you lodge your application.

Lodging an application

You will need to engage a surveyor to design your subdivision so it complies with the relevant assessment criteria. You may also choose to have a pre-consultation meeting with the Department of Town and Country Planning to help you prepare your planning application. This is not mandatory but will save you time and make the process easier.

Application Timeline

The processing time line for subdivision applications is 30 working days. During the assessment period, the Department liaises with the surveyors for further information and amendments if necessary.

Expired Approvals

Scheme approvals given by the Department of Town & Country Planning have a validity of two (2) years. If your scheme approval has expired, your can request for the scheme to be renewed with a renewal fee. Application to renew scheme approvals are lodged with the Department of Town & Country Planning Suva Office.

Scheme Amendments

If you wish to make changes to a subdivision scheme which has already been approved, you can lodge an amended scheme with the Department of Town & Country Planning for approval. When lodging an amended scheme application, you must include:

  • Five (5) copies of the amended scheme
  • A covering letter outlining the details of the amendment
  • A copy of the initial scheme approval

You may incur additional fees if you are increasing the number of lots in your amended scheme plan.
